In the event of pressure to set up Tribunals oy other claimants e.g. by those in respect of whose saips no Notices of Requisition were served before denial action was taken, it would appear that as we would have no answer to Mandamus proceedings by way of prerogitive writ, arrangements will consequently have to be made at an early date for the appointment of Tribunals and promulgation or rules governing their proceedings, such cases where 'de facto' requisitioning would probably be alleged, we would of course apply under regulation 9 for question of law to be stated in the form of a special case for the opinion of the Supreme Court, and you would be advised.

6. I am being pressed by the solicitors mentioned in paragraph 3 to declare Governments stand by end of the month in the light of public announcement of intentions to settle legal claims. Shall be grateful for confirmation, therefore, that you see no objection to course proposed in paragraph 4 and 5 above, I assumed that words "goods or equipment" in your savingram No.83 excludes ships.
